DMCA Policy

Last updated: [EFFECTIVE DATE]

Modern Creations Construction Co, LLC respects the intellectual property rights of others and expects the same of anyone who provides content for this website. This policy explains how we respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Filing a notice of infringement

If you believe material on this website infringes a copyright you own or are authorized to enforce, send a written notice to our designated agent (below). Under 17 U.S.C. § 512(c)(3), a valid notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to be infringed (or, for multiple works, a representative list).
  • Identification of the material claimed to be infringing, with enough information for us to locate it, such as the page URL.
  • Your contact information: name, mailing address, telephone number, and email address if available.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Notices missing these elements may not be acted on.

Designated agent

Send notices and counter-notices to our designated DMCA agent:

[DMCA AGENT NAME]
Modern Creations Construction Co, LLC
[DMCA AGENT ADDRESS]
Phone: [DMCA AGENT PHONE]
Email: [DMCA AGENT EMAIL]

[DMCA AGENT REGISTRATION: the agent above must be registered with the U.S. Copyright Office's DMCA Designated Agent Directory before launch. Replace this note once registered.]

Filing a counter-notice

If material you provided was removed or disabled and you believe this was a mistake or misidentification, you may send a counter-notice to our designated agent. Under 17 U.S.C. § 512(g)(3), it must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice or their agent.

When we remove or disable access to material in response to a notice, we take reasonable steps to promptly notify the person who provided it. When we receive a valid counter-notice, we will promptly forward a copy to the person who filed the original notice and tell them the material may be restored in 10 business days. Unless that person notifies us that they have filed a court action seeking to restrain the activity, the removed material may be restored in not less than 10 and not more than 14 business days after we receive the counter-notice, as provided in 17 U.S.C. § 512(g)(2).

Repeat infringers

Where appropriate, we will remove content from, and end the participation of, anyone who is found to repeatedly infringe the copyrights of others.

Misrepresentations

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. If you are unsure whether material infringes your rights, consider consulting an attorney before sending a notice.
